Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Shopify Theme Create (the “Service”), an independent SaaS that generates Shopify Online Store 2.0 theme bundles. By creating an account or using the Service you agree to be bound by these Terms.

1. Eligibility

You must be at least 16 years old and have the legal capacity to enter into a contract. If you use the Service on behalf of an organisation, you represent that you have the authority to bind that organisation.

2. Account and security

  • You are responsible for keeping your sign-in credentials confidential.
  • You must not share your account with third parties.
  • Notify us at harundede84@gmail.com immediately if you suspect unauthorised access.

3. Credits and billing

  • One theme generation consumes one credit.
  • New accounts receive a limited number of free credits at signup; the exact amount can change without prior notice.
  • Paid plans add credits on a recurring basis. Unused credits do not roll over indefinitely; the rollover window is shown on the pricing page.
  • Credits are personal, non-transferable, and non-refundable except where required by mandatory consumer-protection law.

4. Acceptable use

You agree not to:

  • upload content you do not own or are not licensed to use;
  • upload material that is illegal, infringing, defamatory, hateful, sexually explicit, or that depicts minors in any sexual context;
  • generate themes intended to defraud customers (phishing, fake checkouts, deceptive look-alike stores);
  • reverse-engineer or attempt to extract the underlying prompts, model weights, or proprietary code of the Service;
  • circumvent rate limits, credit limits, or authentication checks;
  • use the Service to compete directly with Shopify Theme Create or to train another generative model.

5. Your content and licence to us

You retain ownership of the brief, logos, photos, and other media you upload (“User Content”). You grant us a non-exclusive, worldwide, royalty-free licence to host, process, and transmit User Content solely to deliver the Service to you. We do not use your User Content to train AI models.

6. Generated themes

Subject to your full payment of any applicable fees and your compliance with these Terms, you own the .zip bundles that the Service produces for you (“Generated Output”). The Generated Output may contain open-source components subject to their own licences (listed in the bundle’s LICENSES.md).

7. Third-party services

Shopify, Google, Vercel, Supabase, Anthropic, AWS, and Resend are third-party services we rely on. Your use of any third-party service through the Service is governed by that service’s own terms. We are not responsible for outages, data loss, or policy changes on those platforms.

8. Shopify connection

Connecting your Shopify store is optional. By connecting a store you authorise the Service to call the Shopify Admin API on your behalf, within the scopes you grant during OAuth. You are responsible for complying with the Shopify API Terms of Service and the Shopify access-scope documentation. You can revoke access at any time from your Shopify Admin or from the Service’s panel.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated content may contain inaccuracies; you are responsible for reviewing each Generated Output before publishing it.

10. Limitation of liability

To the maximum extent permitted by law, the Service’s aggregate liability for any claim relating to the Service is capped at the amount you paid in the 12 months immediately preceding the event giving rise to the claim. The Service is not liable for lost profits, lost revenue, lost data, or for indirect, incidental, or consequential damages.

11. Indemnity

You agree to defend and indemnify the Service against claims arising from your User Content or your breach of these Terms.

12. Termination

  • You may delete your account at any time from the panel.
  • We may suspend or terminate accounts that violate these Terms.
  • Upon termination, your right to use the Service ends; sections that by their nature should survive (IP, liability, disclaimers, governing law) will survive.

13. Changes

We may update these Terms. Material changes will be announced at least 14 days in advance. Continued use of the Service after that effective date constitutes acceptance.

14. Governing law

Until a registered legal entity is announced, these Terms are interpreted under the laws of the Republic of Türkiye, and the courts of Istanbul shall have non-exclusive jurisdiction, without prejudice to mandatory consumer rights in your country of residence.
